CPD Lesson Outline and Objectives

1.     
Canadian Immigration Law and Study Permits (30 minutes)

·       Overview of Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR) related to study permits

·       Important IRPR sections: s 214, s 215(1)-(2), s 216(1), s 217(1)-(2), s 220, s 220.1 (1)

·       Key principles and objectives relevant to study permits and work permits.

·       Discussion on the significance of these changes for prospective immigrants and consultants.

·       Ethical considerations in advising clients on study and work permits.

 

2.      The Study Permit Process. (30 minutes)

 

·       Eligibility criteria, required documents, and the application process.

·       The role of Designated Learning Institutions (DLI).

·       Revolutionary changes made on Dec 7, 2023, and Jan 22, 2024

o   DLI confirming acceptance letters with IRCC.

o   Analysis behind the changes with reference to Statistics Canada data

 

·       Case Study Discussion:

o   Common challenges in obtaining a study permit.

o   Red flags in a typical study permit application 

o   CICC professional conduct:  s 18(2)-(3) - Conflict of interest — student recruitment services 

 

3.      The Relationship Between Study Permits and Work Permits (30 minutes)

 

·       Understanding Types of Work Permits related to students.

·       Eligibility criteria for students who want to work, PGWP, duration, and conditions.

·       Strategies for Success

o   How to enhance the approval chances for PGWP and extension.

o   Addressing gaps in study, part-time status, and online courses.

o   Case Study Analysis: Navigating PGWP refusals and appeals.

·       Dealing with refusals, inadmissibility on medical or criminal grounds, and misrepresentation.

·       Strategies for rehabilitation and overcoming inadmissibility.

·       Long-term strategy for students who plan on eventually becoming PRs:

o   Overview of Express Entry, Canadian Experience Class, and Provincial Nominee Programs.

o   Eligibility criteria, Comprehensive Ranking System (CRS) scores, and strategic considerations for applicants.

·       Introduction to legal databases such as LexisNexis, Westlaw, and CanLII

·       Demonstrations on how to search for relevant case law, legislation, and regulations related to study permits and work permits

·       Tips for effective keyword searches and filtering results to find the most relevant information

 

6.      Q&A, Review and Conclusion (30 minutes)

·       Sharing additional tips and resources among participants

·       Recap of key takeaways: The crucial role of ethics in immigration consultancy and the impact of the 2024 changes on study and work permit applications.
