Case Scenario: eTA, Business Visitors, ICT

Mr. Polo from Brazil (visa-exempt country) wants to visit Canada for a business meeting. He works for a renowned multinational company headquartered in the USA but has branches in several countries including Brazil and Canada.
He wants to come for about a seven-day trip this time but may need frequent visits later. Also, because of his leadership role, sometimes he needs to visit Canada for global conferences and sometimes for operational activities that collaborate with the Brazil and Canada office.
Sometimes he may need to visit only for the benefit of the Canadian entity for a duration of 15-30 days, which means he will come here as an expert helping the Canadian office.
He is also considering if he likes to work with the Canadian office and likes Canada overall, he will consider getting transferred from their Brazilian office to the Canadian office.

Questions from the client:

• What application does he need to apply for so that he can serve all the purposes described above?
• Is there any way he can get a Work Permit to work in Canada? If possible, then what are the requirements? Will he need an LMIA, or is that LMIA exempted?
• If he works for some years in Canada, can that lead him towards any of the PR application processes in Canada?
Brainstorming agenda:
• How to determine if Mr. Polo is a legitimate business visitor or not?
• Will Electronic Travel Authorization (eTA) be sufficient for his visit, or does he need to apply for a work permit?
• Is there any LMIA exemption for such scenarios, or is LMIA a must?
• Under which conditions can one apply for Intra-Company Transfer?
• What are the IRPR sections we (as RCIC) need to consider for Mr. Polo’s situation?
• Will the thought process be changed if Mr. Polo is from a visa-required country?
• How much fee should be reasonable for eTA application, work permit without LMIA exemption, Intra-Company Transfer?
